These Terms and Conditions govern Your use of the Service operated by Darksy OU, a company registered in Estonia.

Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Definitions
For the purposes of these Terms and Conditions:
Service means the website and web-based platform operated by the Company under the name “Yumly AI”, accessible via a web browser.
Website refers to Yumly AI, accessible from the official domain provided by the Company.
Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Darksy OU, a company incorporated under the laws of Estonia.
Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
Country refers to: Estonia.
Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet with internet access.
Free Trial refers to a limited period of time that may be free when purchasing a Subscription.
Subscription means a paid plan that grants access to premium features of the Service on a recurring basis.
Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Services means any services or content (including payment providers, analytics services, or AI providers) provided by a third party that may be used in connection with the Service.
You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
Acknowledgment
These Terms and Conditions form a legally binding agreement between You and Darksy OU regarding the use of the Service.
By accessing or using the Service, creating an account, or purchasing a Subscription, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access or use the Service.
You represent that You are at least 18 years old. The Company does not permit individuals under 18 to use the Service.
Your use of the Service is also conditioned on Your acceptance of and compliance with Our Privacy Policy.
Subscriptions
Subscription Period
Access to certain features of the Service requires a paid Subscription. Subscriptions are billed in advance on a recurring basis (monthly, annually, or as otherwise specified at the time of purchase).
Your Subscription will automatically renew at the end of each billing cycle unless You cancel it prior to the renewal date.
Subscription Cancellation
You may cancel Your Subscription at any time through Your account settings (if available) or via the subscription management link provided in Your purchase receipt.
Cancellation prevents future renewals. Your Subscription will remain active until the end of the current billing period.
Billing and Payments
Payments are processed by Paddle.com Market Limited and/or its affiliates (“Paddle”), which acts as the Merchant of Record and authorized reseller for transactions completed through the Service.
By purchasing a Subscription, You authorize Paddle to charge the applicable Subscription fees in accordance with the selected billing cycle.
You agree to provide accurate and complete billing information.
Refunds
Refunds are governed by the Refund Policy and Paddle’s Consumer Terms.
If You are a consumer, You may be entitled to request a refund within 14 days of purchase in accordance with applicable law and Paddle’s policies:
Approved refunds will be issued to the original payment method.
Free Trial
The Company may offer a Free Trial for a limited period.
Unless You cancel before the Free Trial expires, Your Subscription will automatically convert to a paid plan and the applicable fee will be charged by Paddle.
Acceptable Use
You agree not to:
Use the Service for unlawful purposes
Attempt to gain unauthorized access to the Service
Interfere with or disrupt the Service
Use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce
Misuse AI-generated content in violation of applicable laws
The Company reserves the right to suspend or terminate accounts that violate these Terms.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Darksy OU and its licensors.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal or internal business purposes.
Limitation of Liability
To the maximum extent permitted by law, Darksy OU’s total liability under these Terms shall not exceed the total amount paid by You in the three (3) months preceding the claim.
In no event shall Darksy OU be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
"AS IS" Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
The Company does not guarantee that the Service will be uninterrupted, secure, error-free, or that AI-generated results will be accurate, complete, or suitable for any particular purpose.
Governing Law
These Terms shall be governed by the laws of Estonia, without regard to its conflict of law principles.
Dispute Resolution
If You have any dispute or concern regarding the Service, You agree to first contact Darksy OU to attempt to resolve the issue informally.
Changes to These Terms
The Company reserves the right to modify these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
